1. Introduction
The website, the Objais mobile application (iOS and Android) and all related content (hereinafter the "Application") are provided by Quotinsure Lda, a company registered in Portugal and acting as an insurance broker (ASF Registration number: 426 595 742).
The Application allows users to (i) obtain an indicative, non-binding estimate of a potential insurance premium from a photograph, and (ii) create and manage collections of objects and valuables.
Objais is an insurance broker. It is neither an art expert nor a marketplace. The indicative estimates provided by the Application do not constitute an insurance offer or a quotation.
Requests for a formal quote or insurance proposal submitted through the Application are handled either by Objais itself or by one of its partner brokers, under the conditions set out in Article 4 and in our Privacy Policy.
By downloading, accessing, or using the Application, or by subscribing to a paid plan, you unconditionally accept these Terms and Conditions. If you do not agree to these Terms, you must not use the Application.
The use of your personal data through the Application is governed by our Privacy Policy, available within the Application and on our website.
Objais reserves the right to modify these Terms at any time. Any change will be notified within the Application. Your continued use of the Application after publication of such modifications constitutes acceptance of the revised Terms.
2. Access to the Application
The Application is intended for users aged 18 and over. You must have a compatible device, an Internet connection, and, where applicable, an account on a third-party app store.
Objais does not guarantee uninterrupted or error-free access. Certain features may be restricted to registered users.
3. Registration and Security
Some features require the creation of an account. You are responsible for the accuracy of the information provided, for maintaining the confidentiality of your login credentials, and for all activities carried out under your account.
When creating your account, it is recommended that you use a pseudonym and, if possible, an email address that does not directly identify you.
Objais reserves the right to suspend or terminate any account in the event of non-compliance with these Terms or misuse of the service.
4. Nature of the Service and Scope of Insurance Estimates
The Application allows users to obtain a non-binding, indicative estimate of a potential insurance premium, generated from a photograph and the information provided by the user. These estimates are provided for informational purposes only. They are indicative and non-contractual and constitute neither an insurance offer nor a quotation.
Only Objais or its authorised partners are qualified to issue a formal quote and a personalised insurance proposal, upon a request submitted by the user through the dedicated form available in the Application.
4.a Transmission of your request to partners
When you submit a request for a formal quote through the dedicated form, your request is handled either by Objais itself or, in certain cases, by one or more of its partners, so that it can be processed and a response provided to you. This transmission is necessary to process your request: without it, no response can be provided.
Depending on the coverage sought and the applicable territory, a partner may be located within or outside the European Union. Where a partner is located outside the European Union, the transfer of your data is governed by appropriate safeguards (an adequacy decision of the European Commission or Standard Contractual Clauses), as described in our Privacy Policy.
In certain cases, Objais may transfer your request to a partner who will then process it as an independent data controller and become responsible for the subsequent handling of your data. Where this applies, it is described in our Privacy Policy.
The estimates provided by the Application remain indicative and non-contractual and constitute neither an insurance offer nor a quotation. Only Objais or its authorised partners may issue a formal quote and a personalised insurance proposal.
5. Acceptable Use
You agree to use the Application:
- for personal, non-commercial purposes;
- in accordance with applicable laws and these Terms.
You must not:
- copy, distribute, reproduce, or modify the content of the Application;
- use the Application in a fraudulent, harmful, or abusive way (e.g., viruses, automated data extraction, scraping, etc.);
- post or transmit any unlawful, defamatory, inappropriate, or copyrighted content without authorisation.
Objais reserves the right to delete or block any account or content that violates these rules.
6. User-Generated Content
In connection with the collection-management features, users may submit content (texts, images, videos, reviews, or other media). By doing so, you confirm that you hold all necessary rights and grant Objais a worldwide, free, non-exclusive, and irrevocable licence to use such content within the Application (display, promotion, archiving, etc.).
This Article applies to content published in the collection-management features. Photographs and information submitted solely to obtain an insurance estimate or a quote are processed for that purpose only, in accordance with our Privacy Policy, and are not made public.
Objais acts as a content host and cannot be held liable for information published by users. Objais reserves the right to delete or modify any content that violates the law or these Terms, without prior notice.
A reporting mechanism is available to flag inappropriate content.
7. Intellectual Property
The Application, including its code, design, logo, content, and structure, is protected by intellectual property rights. Objais (Quotinsure Lda) or its licensors hold all ownership rights. No property rights are transferred to the user.
Certain elements may include open-source components governed by their own licences.
Any reproduction, modification, or unauthorised use of Objais content is strictly prohibited.
8. Objais Publishing Charter
(Rules for the acceptance and moderation of items published in the collection-management features. This Article applies only to content that users choose to publish in their collections, and not to photographs or information submitted solely to obtain an insurance estimate or quote.)
8.1 Authenticity and Accuracy
- The items or objects must actually exist or be the original creation of the user.
- The information provided (title, description, author, date, medium, etc.) must be accurate and verifiable.
- Digital works must be clearly identified as such (NFT, AI-generated creation, digital art, etc.).
8.2 Quality and Visual Presentation
- Images must be clear, sharp, and faithfully represent the item shown.
- Physical objects should be photographed without blur, excessive shadows, or misleading editing.
- Digital works must be presented accurately and in full.
8.3 Copyright and Intellectual Property
- The user must hold the publication and distribution rights for any content uploaded.
- Copyrighted works may only be published with the explicit authorisation of the rights holder.
- Public domain works may be used to create imaginary collections or reproductions, under the user's sole responsibility.
- Objais declines any liability for potential third-party rights violations.
8.4 Privacy and Respect for Others
- Images must not contain recognisable faces or personal data.
- Users agree to respect the privacy and image rights of others.
8.5 Prohibited Content
- No content of an illegal, violent, hateful, sexual, political, or discriminatory nature is permitted.
- Depictions of weapons or dangerous objects are allowed only within a clearly defined artistic or historical context.
8.6 Categorization and Editorial Line
- The item must be placed in the appropriate category (art, jewellery, design, photography, digital art, yacht, etc.).
- Items with no artistic, historical, or heritage value, and which do not correspond to the Objais universe, may be refused.
8.7 Public / Private Status
- The user must explicitly choose whether the content is public or private.
- No default status is pre-selected.
- The status may be changed at any time from the user's account.
8.8 Validation and Moderation
- All content is subject to Objais moderation before publication.
- Objais may refuse, hide, or remove any content that violates this charter or applicable law.
8.9 User Responsibility
- The user is solely responsible for all content published.
- Objais cannot be held liable for any infringement of copyright, image rights, or intellectual property committed by users.
9. Personal Data
Your data is processed in accordance with our Privacy Policy, available within the Application and on our website. The Privacy Policy describes, in particular, the data collected to provide insurance estimates and quotes, the recipients of that data (including partner brokers within or outside the European Union), the safeguards applicable to transfers outside the European Union, and your rights.
To preserve your anonymity in the collection-management features, only the city and country of residence may be displayed. When creating your account, we recommend using a pseudonym and, where possible, an email address that does not directly identify you.
10. External Links
The Application may contain links to third-party websites. Objais is not responsible for their content, operation, or availability.
The inclusion of any link does not imply approval or endorsement by Objais.
11. Suspension or Termination
Objais may suspend or terminate your access without prior notice in the event of:
- a breach of these Terms;
- abusive or fraudulent behaviour;
- activity contrary to applicable law;
- inactivity for more than six (6) months.
In case of termination, access to your account and your content will be discontinued; your content will not be retained and will be deleted. Objais reserves the right to take any appropriate legal action.
11.1 Deactivation and Automatic Deletion of Inactive Accounts
To ensure data security and the proper functioning of the platform, Objais reserves the right to deactivate and delete any account that has remained inactive for a continuous period of six (6) months.
An account is considered inactive when none of the following actions have been performed by the user:
- logging into the Application;
- adding or modifying an item or collection;
- using social features (likes, comments, following);
- interacting with Objais services.
Before any permanent deletion, the user will receive an email notification informing them of the upcoming deactivation of their account and will have a 30-day period to log in and reactivate it.
After this period, the account and all associated data (profile, collections, content, interactions) will be permanently deleted. Objais cannot be held liable for any loss of information resulting from such deletion.
12. Availability and Updates
Objais reserves the right to modify, improve, or discontinue the Application at any time.
Certain updates may be required to continue using the service.
13. Limitation of Liability
Objais shall not be held liable for:
- commercial, indirect, or consequential losses;
- lost, corrupted, or deleted data;
- temporary unavailability of the service.
Objais's total liability is limited to the amount paid by the user in the 12 months preceding the event giving rise to the claim, or €300, whichever is greater.
Objais does not exclude liability in cases of gross negligence, fraud, death, or personal injury resulting from its own acts or omissions.
14. Governing Law and Jurisdiction
These Terms are governed by Portuguese law. Any dispute shall be submitted to the competent courts of Lisbon, unless otherwise required by mandatory local law.
